These Terms and Conditions ("Terms") govern your use of the Visionary Media Sol website and the website design, digital marketing, and related services we provide. By engaging our services or using our website, you agree to these Terms.
1. Definitions
- "We", "us", "our" refers to Visionary Media Sol
- "You", "client" refers to the person or business engaging our services
- "Services" refers to website design, development, SEO, social media, branding, AI automation, and related services
- "Package" refers to a defined website build package (Starter, Business, Growth, or Enterprise)
2. Website Development Services
Scope
Each package includes the features listed on our pricing page at the time of purchase. The specific scope of your project will be agreed in your project specification or brief. Work outside the agreed scope may be quoted separately (see Section 5).
Delivery estimates
Delivery times (5–7 working days for Starter, 7–10 for Business, 10–14 for Growth) are estimates and depend on the client providing all required content, information, and feedback on time. We are not liable for delays caused by late client responses or scope changes.
Pages and functionality
Package page limits (e.g. up to 4 pages for Starter, up to 8 for Business) are defined in the package description. For Growth and Enterprise packages, pages and functionality are as agreed in your project specification. Additional pages or functionality beyond the agreed scope will be quoted separately.
3. Revision Rounds
Each package includes a defined number of design revision rounds: Starter includes 3, Business includes 5, Growth includes 8, and Enterprise includes unlimited design revisions during the agreed design phase and within the agreed project scope.
A revision round is one consolidated set of reasonable design and content amendments submitted together by the client. New functionality, additional pages, or work outside the agreed project scope may be quoted separately and is not counted as a revision.
4. Client Responsibilities
- Provide accurate and complete information for your project brief
- Supply required content (text, images, logos, brand assets) in a timely manner
- Ensure you have the right to use any content or assets you provide
- Review work and provide consolidated feedback within agreed timeframes
- Provide access to third-party accounts where required (e.g. domain registrar, social media)
- Respond to communications within a reasonable timeframe to avoid project delays
5. Additional and Out-of-Scope Work
Any work requested that falls outside the agreed project scope — including but not limited to additional pages, new functionality, major design changes after design approval, or content creation — will be quoted separately and must be agreed in writing before work commences.
6. Payment
Website packages
Website package prices are listed on our pricing page. Launch offer pricing is a limited-time promotional price; the standard price is shown for reference. Full payment is due via Stripe checkout at the time of ordering unless otherwise agreed for Enterprise custom quotes.
Monthly services
Monthly services (SEO, Meta Ads Management, Social Media Management) are billed monthly in advance via Stripe subscription. You may cancel with 30 days' notice. Advertising spend for Meta Ads is paid separately and is not included in the management fee.
Enterprise custom quotes
Enterprise projects are custom-quoted. Payment terms (including any deposit and milestone payments) will be specified in your custom quotation.
7. Hosting, Domain & SSL
Every website package includes 12 months of shared hosting, a standard .co.uk domain (subject to availability — premium domains are excluded), and an SSL certificate. Hosting is included for the first 12 months only. Renewal charges apply after the included period. Clients will be informed of the applicable renewal price before renewal.
8. Cancellation
Website packages
As website builds are bespoke and commence immediately upon payment, package purchases are non-refundable once work has begun. If you cancel before work has commenced, a full refund will be issued. If you cancel after work has begun, you will be charged for work completed up to the point of cancellation.
Monthly services
Monthly service subscriptions can be cancelled with 30 days' notice. No refunds are provided for partial billing periods. You remain responsible for any advertising spend incurred on your behalf up to the cancellation date.
9. Intellectual Property
Upon full payment, ownership of the final website design and its content transfers to the client. We retain the right to use the completed work in our portfolio and marketing materials unless you request otherwise in writing. Underlying third-party software, themes, plugins, and tools remain licensed under their respective terms. We retain ownership of any proprietary frameworks, templates, or tools used in the development process.
10. Third-Party Services
We may use and integrate third-party services including but not limited to Stripe (payments), Google (analytics, search console), Meta (advertising, pixel), domain registrars, and hosting providers. We are not responsible for the actions, availability, or policies of third-party services. You are responsible for any fees charged by third-party services that are not included in your package.
11. SEO & Advertising Results
While we use best-practice SEO and advertising techniques, we do not guarantee specific search engine rankings, traffic levels, lead volumes, conversion rates, or revenue outcomes. Results depend on many factors outside our control, including market competition, search engine algorithm changes, and the quality of your products or services.
12. Support Periods
Post-launch support is included as follows: Starter includes 14 days, Business includes 30 days, Growth includes 60 days, and Enterprise includes support as agreed in the project specification. Support after the included period is available via our monthly maintenance services or at an agreed hourly rate.
13. Limitation of Liability
To the maximum extent permitted by law, our liability for any claim arising from our services is limited to the amount you paid us for the relevant service. We are not liable for indirect, consequential, or loss-of-profit damages, or for issues caused by third-party services, client-provided content, or circumstances outside our control.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to These Terms
We may update these Terms from time to time. The effective date will be shown at the top of this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
